The setup
Every so often our team runs an exercise we call marketing fight club. We take two brands in the same industry, competing in the same market, and go through everything a potential customer would see: the website, the TV spots, the Google and Meta ads, the organic social content. Then everyone votes on which brand they'd actually hire.
In January we did personal injury law in Ontario. Diamond & Diamond against Preszler Injury Lawyers.
Both are large, established firms with real budgets. Preszler has been practising since 1959. Diamond & Diamond calls itself the largest personal injury firm in Canada by number of lawyers. Neither is short of money or exposure.
We expected the vote to come down to who looked more professional. It didn't, and that turned out to be the useful part.
Firm 1: Diamond & Diamond
Diamond & Diamond buys reach. TV commercials, billboards, Google Ads, Meta video, Instagram.

If you live in the GTA you have seen them whether you were looking or not.

Here is their 30-second TV spot, close to word for word:
If you are injured, results are the most important thing. They are the only thing that matter. You want a team that will fight for your compensation. You want a tough team of lawyers that are relentless. You want a team that's not afraid to stand up to the big insurance company. Serious injuries need serious results. When it comes to fighting for your rights, there is nothing tougher than a diamond. Call 1-800-567-HURT today for your free consultation.
Diamond & Diamond, 30-second TV commercial
Four things are doing the work in that script, and none of them are expensive:
- A name that is also the promise. Nothing tougher than a diamond. The firm is named after its own positioning, so every mention of the name repeats the claim.
- A phone number you can remember without writing it down. 1-800-567-HURT.
- A sung sign-off at the end of every spot. After enough repetitions it sits in your head whether you like it or not.
- One idea, repeated everywhere. Tough. That's it. Nothing competes with it for attention.
Their proof points are size: 65+ lawyers across Canada, over a billion dollars in gross settlements, "Canada's largest personal injury firm."
Where they leave money on the table
Almost every line is about them. We are the largest. We have 65 lawyers. We recovered a billion dollars. Nothing in the messaging is framed as what the client walks away with.
Their organic content wanders even further. We watched videos on keeping your fuel tank at least half full, on choosing a driving school rather than having a family member teach you, and on who can serve as the executor of a will. Reasonable videos. Almost none of it speaks to a person who was hurt last week and is deciding who to call today.

Firm 2: Preszler Injury Lawyers
Preszler runs a tighter, more conventional campaign.

The founder video opens like this:
Hi, I'm Jeffrey Preszler from Preszler Injury Lawyers. If you've landed on our website, chances are you need legal help from a personal injury lawyer in Ontario. Preszler Injury Lawyers has been helping Canadians get compensation they deserve since 1959.
Preszler Injury Lawyers, homepage video
Their phone number is 1-800-JUSTICE. Same vanity-number play as Diamond, executed just as well.
Where they are clearly better
The content. Two of their videos were the strongest single assets either firm had.
The first is about settling too early:
Once you sign, it's final. No second chances. We make sure clients don't settle until their recovery is clear and their future needs are understood. That patience often means tens or even hundreds of thousands of dollars more in compensation. Don't let the insurer rush you.
The second is about insurer surveillance:
Insurance companies can and do spy on you. They may hire private investigators to follow you, take videos, or comb through your social media. I've even seen them attend weddings as uninvited guests. They're looking for moments to twist, like carrying groceries or attending a family event, to argue you're not as injured as you claim.
That one stopped the room. It names a fear an injured client has but would never say out loud, and it answers it with something specific enough to be useful. Set it next to a video about fuel tanks and the difference is obvious.
Where they lose
The brand is one man. Every video is Jeffrey Preszler, alone, talking to camera. One of our team summed it up: this firm is a person, and the other firm is a team.
And nothing repeats. No phrase, no sound, no single idea you'd be able to bring back a week later. When we asked what anyone remembered at the end of the session, nobody could quote a line from Preszler. Everyone could hum the Diamond & Diamond sign-off.
The vote, and why it went the way it did
Side by side:
| Diamond & Diamond | Preszler Injury Lawyers | |
|---|---|---|
| Memorable hook | Name, tagline and a sung sign-off | None that repeats |
| Phone number | 1-800-567-HURT | 1-800-JUSTICE |
| On camera | A team of lawyers | The founder, alone |
| Main claim | Largest firm, 65+ lawyers, $1B recovered | Practising since 1959, no win no fee |
| Content relevance | Fuel tanks, driving schools, executors | Settling too early, insurer surveillance |
| Offer in ads | Free consultation, no upfront fees | Free case review, you don't pay unless you win |
Diamond & Diamond won, and the vote was close.
What's worth noting is that nobody defended the website, the photography or the production quality. The people who voted for Diamond gave three reasons. It was memorable. It sounded confident, and they believed it would fight for them. And it sold a team rather than one person, which matters when the case is serious.
One person on the call described looking everywhere for a pharmacy's phone number, failing to find it, then remembering the jingle, which had the number in it, and dialling from memory. That is what a memorable asset is worth, and no amount of good design substitutes for it.
Five things your firm can take from this
- Memorable beats tasteful. If nothing in your marketing repeats, there is nothing for a client to recall on the day something happens to them. A phrase, a number, a colour, a face. Pick one and use it everywhere for a year.
- Make the claim about them, not you. "Over $1 billion recovered" is a fact about the firm. "We've recovered over $1 billion for injured Ontarians" is the same fact, pointed at the reader. Go through your homepage and count how many sentences start with we.
- Answer the fear they haven't said out loud. Preszler's surveillance video works because it tells a frightened person something concrete they did not know. Every practice area has two or three of these. They're the best content you will ever make, and they cost nothing but an hour of a lawyer's time.
- "Free consultation" differentiates nothing. Both firms say it. So does nearly everyone in the swipe file below. If it's your main offer, your ad is interchangeable with your competitor's.
- A team reassures more than a founder when the stakes are high. One lawyer on camera reads as one person's availability. A team reads as depth. If you have partners and associates, put them in the frame.
And the encouraging part: both of these firms have national budgets, and almost nothing that decided the vote required one. A repeated phrase, a memorable number, a team photo and one honest video about how insurers actually behave are all within reach of a firm with three lawyers.
These two firms are two of thirty-three.

The part we do by hand
The swipe file shows you what other firms are doing. It doesn't tell you what any of it means for yours.
So there's a second option on the form, and it works differently:
- We pull the numbers for your firm and the three firms beating you in your city
- What they rank for, what they're spending on, what their ads say, where the gaps are
- One of our strategists prints it and goes through it with a pen
- We write in what we'd actually do about each one, for a firm your size
- Then we mail it to your office
Why mail? Because it gets read. And because a printed report can sit on the table at a partners' meeting and get passed down it, which a PDF in someone's inbox does not.
Why only ten a month? Because a person does the markup, and that person is not fast. Ten is what we can do properly. When the month's ten are gone, the box on the form closes until the next one.
What it costs: nothing, and there's no call attached to it. If you read it and want to talk, my email and number are on the last page.

Questions
Is this actually free?
Yes. No call required, no card, nothing gated behind a demo.
Do I have to be a client?
No. Most of the people who download it never speak to us.
Why is the custom report printed and mailed?
Because it's marked up by hand and it's easier to read on paper. It also survives a partners' meeting better than a PDF.
How long is the custom report being offered for?
Custom reports will only be offered until October 10th, at which point we will no longer be taking requests.
Where can the custom report be shipped to?
Custom reports can be shipped anywhere within Canada.
